Terms of use for Quezzi.

1. Definitions

• "Quezzi," "we," "us," or "our" refers to the Quezzi service and its operators.
• "User," "you," or "your" refers to any person who accesses or uses Quezzi.
• "Conversation" means one complete exchange: one message from you and one AI-generated reply from Quezzi.
• "Message" refers to Quezzi's response to you. Your plan limit is based on the number of times Quezzi responds.
• "Service" refers to the Quezzi SMS-based AI assistant platform and all related features.
• "Subscription" refers to your chosen paid plan (Starter, Plus, Pro, or Unlimited).

2. How the Service Works

• You send a text message to Quezzi's phone number
• Quezzi's AI processes your message and generates a response
• You receive Quezzi's reply via SMS
• Each exchange (your message + Quezzi's reply) counts as one conversation
• Quezzi uses advanced artificial intelligence (OpenAI) and may access web search to provide current information when needed

3. Account & Eligibility

3.1 Age Requirements

• Minimum Age: 13 Years Old
• Users must be at least 13 years old to use Quezzi
• We do not knowingly collect information from children under 13
• Accounts created by users under 13 will be immediately terminated
• Some regions may have higher age requirements - users must meet the minimum age in their jurisdiction

3.2 Users Ages 13-17: Parental Consent Required

• Users between 13 and 17 years old MUST have verifiable parental or legal guardian consent
• Parents/guardians must:
  • Provide explicit consent for the minor's use of Quezzi
  • Accept full responsibility for the minor's usage
  • Supervise the minor's interactions with the service
  • Accept liability for all charges and content generated

3.3 Parental Account Requirements

• If you are a parent/guardian allowing a minor (13-17) to use Quezzi:
• You must create and maintain the account in your name
• You are fully responsible for all activity on the account
• You must monitor and supervise all usage
• You accept all financial liability for the account
• You indemnify Quezzi against any claims arising from the minor's use
• You acknowledge that AI responses may not always be appropriate for minors

3.4 Age Verification

• We reserve the right to verify user age at any time
• False age declarations will result in immediate termination
• No refunds for accounts terminated due to age violations
• When a minor account lacks proper consent, all conversation data will be deleted within 30 days

3.5 Account Registration

• Your mobile phone number identifies your account
• You are responsible for maintaining the security of your phone number
• You must provide accurate information during signup
• One phone number = one account (no multiple accounts per number)

3.6 Geographic Availability

Supported Regions

• United States & Canada (phone numbers beginning with +1)
• Australia (phone numbers beginning with +61)

We may expand to additional countries in the future. Service availability, features, and pricing may vary by region.

4. Subscription Plans & Billing

4.1 Available Plans

• Free Trial: 5 conversations (one-time trial per phone number). No credit card required.
• Starter Plan: $4.99 USD/month (US & CA) or $4.99 AUD/month in Australia. 100 conversations per month
• Plus Plan: $9.99 USD/month (US & CA) or $9.99 AUD/month in Australia. 250 conversations per month
• Pro Plan: $14.99 USD/month (US & CA) or $14.99 AUD/month in Australia. 500 conversations per month
• Unlimited Plan: $19.99 USD/month (US & CA) or $19.99 AUD/month in Australia. Unlimited conversations (subject to Fair Use Policy)

4.2 Billing Terms

• Subscriptions are billed monthly in advance
• Charges occur on the same day each month (your billing date)
• Payment must be made via credit card or other approved methods
• Prices are in USD for US and Canadian users and AUD for Australian users
• All prices are subject to change with 30 days' notice

4.3 Payment Disputes & Chargebacks

• Dispute Resolution: Contact [email protected] before initiating chargebacks
• Chargeback Consequences: Initiating a chargeback will result in immediate account suspension, permanent ban from future service, collection proceedings for disputed amounts, and reporting to credit agencies if applicable
• Chargeback Fees: You're liable for any fees we incur from chargebacks (typically $15-25)
• Good Faith Disputes: We'll work with you on legitimate billing errors if contacted first

4.4 Service Availability

• Target availability: 99% uptime measured monthly
• Scheduled maintenance: Notified 24 hours in advance when possible
• No SLA guarantees for consumer accounts
• Force majeure events are exempt from availability targets

5. Message Counting & Plan Limits

5.1 How Message Counting Works

• One conversation = one message from you + one reply from Quezzi
• Your plan limit refers to the number of times Quezzi responds to you
• Both inbound and outbound SMS costs are included in your subscription

5.2 Message Tracking

• Check your remaining balance by texting "BALANCE" to Quezzi
• When your limit is reached, service pauses until your next billing cycle or upgrade

5.3 Monthly Reset

• Unused conversations do NOT carry over to the next month
• Your message allowance resets on your monthly billing date
• This applies to all paid plans

6. Fair Use Policy (Unlimited Plan)

The Unlimited plan is designed for reasonable personal use. To keep Quezzi fair and reliable for everyone:

6.1 Acceptable Use

• Typical daily conversations (up to 20-30 per day)
• Personal research and information gathering
• Educational or entertainment purposes
• Normal human interaction patterns

6.2 Prohibited Activities

• Automated bulk messaging or bot activity
• Commercial resale or redistribution of services
• Using Quezzi as a backend for another application
• Excessive usage (e.g., more than 1,000 conversations per day)
• Sharing your account with multiple people

7. Mobile Provider Charges

• Most phone plans in the US, Canada and Australia include unlimited text messaging, so there's usually no extra cost to use Quezzi.
• If you're on a limited SMS plan, your carrier may charge standard rates
• These charges are from your carrier, not Quezzi
• Quezzi is not responsible for carrier charges
• Check with your mobile provider if unsure about your plan

8. Refund & Cancellation Policy

8.1 Cancellation

• You may cancel your subscription at any time
• Cancellation takes effect at the end of your current billing period
• You retain access until your paid period ends
• No partial refunds for unused time or messages

8.2 Service Issues

If you experience technical problems preventing service access for more than 48 consecutive hours, contact [email protected]. We may provide a prorated credit at our discretion.

8.3 No Refunds for Violations

Refunds are not provided if your account is terminated for violating these Terms.

9. Account Termination

9.1 Termination by You

• Cancel anytime through account settings or support
• Access continues until the end of the paid period
• Account and conversation history are deleted after the billing period ends

9.2 Termination by Quezzi

We may suspend or terminate accounts that:

• Violate these Terms or Acceptable Use Policy
• Engage in fraudulent activity or chargebacks
• Abuse the Fair Use Policy
• Compromise system security

10. Acceptable Use Policy

Our content policies align with OpenAI's usage policies. You agree not to use Quezzi to:

10.1 Illegal Activity

• Violate any local, state, national, or international laws
• Engage in or promote illegal activities
• Facilitate fraud, scams, or deceptive practices

10.2 Child Safety

• Generate content that exploits or harms children
• Create content involving minors in inappropriate contexts
• Attempt to groom, abuse, or sexualize minors

10.3 Hate, Harassment & Violence

• Generate content that expresses, incites, or promotes hate
• Harass, bully, threaten, or intimidate individuals
• Promote or encourage self-harm
• Create content that promotes violence

10.4 Malware & System Abuse

• Generate malware, viruses, or malicious code
• Attempt to compromise or hack systems
• Use automated tools or bots with Quezzi
• Deliberately overload the service

10.5 Additional Prohibited Content

• Sexually explicit or suggestive content
• Political campaigning or bulk messaging
• Academic dishonesty or plagiarism
• Privacy violations or surveillance
• Copyright or intellectual property infringement

11. AI Limitations, Liability & Your Obligations

11.1 How AI Works

• Quezzi uses artificial intelligence (OpenAI) to generate responses. While we strive for accuracy, AI has important limitations:
• Responses may contain errors or inaccuracies
• AI can "hallucinate" - generating false information
• Information may be outdated
• Context may be misunderstood
• Web search results may be inaccurate

11.2 User Indemnification

You agree to indemnify, defend, and hold harmless Quezzi and its affiliates from any claims, damages, or expenses arising from:

• Your use or misuse of AI-generated content
• Actions taken based on AI responses
• Your reliance on AI information
• Distribution of AI-generated content
• Harm to third parties from your use
• Your violation of these Terms

11.3 Web Search Integration

• When Quezzi performs web searches:
• Results come from third-party sources
• We don't verify search accuracy
• You assume all risk for using search results
• We're not liable for external content

11.4 Not Professional Advice

Quezzi should NOT be used for:

• Medical or mental health advice
• Legal advice or interpretation
• Financial or investment advice
• Professional services
• Emergency situations

13. Limitation of Liability

13.1 Maximum Liability

To the maximum extent permitted by law, Quezzi's total liability shall not exceed the amount you paid in the 12 months prior to the claim.

13.2 Excluded Damages

Quezzi is not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, data loss, or service interruptions.

14. Privacy

Your privacy is important to us. Our Privacy Policy, available at /privacy, explains how we collect, use, and protect your information. By using Quezzi, you consent to our data practices as described in the Privacy Policy.

15. Intellectual Property

15.1 Quezzi's Property

All Quezzi content, features, and functionality are owned by Quezzi and protected by intellectual property laws.

15.2 Your Content

• You retain ownership of content you send to Quezzi
• You grant us a license to process your messages
• This license terminates when you delete your account

15.3 AI-Generated Content

• AI responses are provided for your personal use
• Commercial use requires permission
• We don't claim ownership of AI-generated content

16. Changes to Terms

• We may update these Terms from time to time
• Material changes will be notified via SMS or email
• Changes effective 30 days after notification for existing users
• Continued use constitutes acceptance of updated Terms

17. Dispute Resolution & Governing Law

17.1 Governing Law

These Terms are governed by the laws of New South Wales, Australia, without regard to conflict of law principles.

18.4 Assignment

You may not assign these Terms. We may assign our rights without restriction.

18.5 Force Majeure

We're not liable for delays or failures due to causes beyond our reasonable control.
